AJGA SMS Terms & Conditions

Please read these SMS Terms & Conditions (the “SMS Terms”) carefully. These SMS Terms are incorporated into our Terms of Use , and should therefore be read in conjunction with our Terms of Use and our Privacy Policy . By enrolling or otherwise agreeing to receive text messages from or on behalf of the AJGA or by otherwise providing your phone number to AJGA, you agree to these SMS Terms, as well as AJGA’s Terms of Use and Privacy Policy , which are incorporated herein by reference and can be viewed at the links provided here, or at ajga.org .

PLEASE NOTE: THE DISPUTE RESOLUTION POLICY INCORPORATED INTO OUR TERMS OF USE APPLY ALSO TO THESE SMS TERMS. IT CONTAINS AN ARBITRATION PROVISION WITH A CLASS ACTION WAIVER THAT AFFECTS YOUR RIGHTS. THE DISPUTE RESOLUTION POLICY AFFECTS HOW DISPUTES WITH THE COMPANY ARE RESOLVED. BY USING OUR SMS PROGRAM(S), YOU AGREE TO BE BOUND BY OUR DISPUTE RESOLUTION POLICY . IN ARBITRATION, THERE IS NO JUDGE OR JURY AND THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. PLEASE READ OUR DISPUTE RESOLUTION POLICY CAREFULLY.

Opting into Text Messages

By opting into any AJGA text program, you (i) represent that, if you are under the age of legal majority in your jurisdiction, you have done so with the express consent of your parent or legal guardian, and you (ii) expressly consent to receive recurring informative and/or marketing text messages that may be sent using an automatic telephone dialing system, by or on behalf of AJGA, at the cell phone number you provide us. By voluntarily providing your cell phone number to AJGA, you consent to receive information, transactional, or operational text messages at that phone number, including but not limited to membership enrollment; tournament fees; informational announcements; and event reminders. Please note we may not be able to deliver messages to all mobile carriers. Consent to receive texts is not a condition of purchasing any goods or services, and you understand and agree that all text messages may be sent using automated technology.

How to Opt Out and Get Help

If you wish to stop receiving text messages from us, or no longer agree to these SMS Terms, you agree to reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us in order to opt out of the program. You may receive an additional mobile message confirming your decision to opt out. You understand and agree that the foregoing options are the only available methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not an available means of opting out. If you need further assistance, text HELP to the number sending the message. After opting out of receiving text messages, you can re-enroll in our text messaging program(s). We would be happy to welcome you back.

Cost

Message and data rates may apply for any messages sent to you from or on our behalf, and messages you send to us. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Eligibility

If you use or engage with AJGA’s text messaging program(s) and are under the age of eighteen (18), you must have your parent’s or legal guardian’s permission to do so. By doing so, you acknowledge and agree that if you are under the age of eighteen (18) you have your parent’s or legal guardian’s permission to use or engage with our text messaging program(s), or are of adult age in your jurisdiction. By using or engaging with our text messaging program(s), you also acknowledge and agree that you are permitted by your jurisdiction’s applicable law to use and/or engage with the platform.
 

Participant Requirements

You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

Duty to Notify and Indemnify

If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these terms and conditions. You further agree that, if you discontinue the use of your mobile telephone number without notifying AJGA of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by AJGA, or any party that assists in the delivery of the mobile messages, as a result of claims brought by individual(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our programs. Mobile carriers are not liable for delayed or undelivered messages.

YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD AJGA HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY AJGA OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM US ATTEMPTING TO CONTACT YOU AT THE MOBILE TELEPHONE NUMBER YOU PROVIDED.

Prohibited Content

You acknowledge and agree to not send any prohibited content over the Platform. Prohibited content includes:

Any content prohibited under our Terms of Use ; any fraudulent, libelous, defamatory, scandalous, threatening, harassing, or stalking activity; objectionable content, including profanity, obscenity, lasciviousness, violence, bigotry, hatred, and discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation, or age; pirated computer programs, viruses, worms, trojan horses, or other harmful code; any product, service, or promotion that is unlawful where such product, service, or promotion thereof is received; any content that implicates and/or references personal health information that is protected by the Health Insurance Portability and Accountability Act (“HIPAA”) or the Health Information Technology for Economic and Clinical Health Act (“HITEC” Act); and Any other content that is prohibited by applicable law in the jurisdiction from which the message is sent.

Changes to the SMS Terms

These SMS Terms may be updated by AJGA at any time without prior notice. By providing your cell phone number for transactional, operational, or informational text messages, or by continuing to be enrolled in any AJGA text messaging program, or you agree to any changes.
